Privacy Policy

1 General Provisions and Definitions

 1.1 The data controller of personal data is Gredos OÜ, registry code 12172083 (“the Manager”). Upon necessity, the Manager may transmit data to its partners who are bound by the same Privacy Policy.

 1.2 This privacy policy (“the Privacy Policy”) applies in cases the Manager as a data controller processes the personal data of the Users of web platform fintewor.com (“the Platform”) who use the Platform according to the Platform’s intended purpose within the scope of the Platform. The Manager is not liable for privacy policies of third persons nor for the processing of personal data by or via third persons even if the third person has gained access to the data by means of the Platform if the access was not granted by the Manager.

 1.3 The Privacy Policy is not applicable if the Users communicate with each other or one User processes another User’s personal data outside of the Platform. In that case, the Users are independent processors of personal data, but the Users undertake to comply with the Agreement and legislation on data protection.

 1.4 The Privacy Policy is not applicable where the Manager has linked the use of the Platform or agreed to its linking with another platform. Inter alia, agreement to a linking is defined as a situation where a User enters another platform via the Platform or enters the Platform via another platform.

 1.5 Legislation governing data protection denotes all legislation on data protection that the Manager is obliged to comply with, including, but not limited to, the General Data Protection Regulation of the European Union and national legislation.

 1.6 The users are obliged to submit only personal data that are correct.

 1.7 Terms that do not have a definition in the Privacy Policy have been defined in the Terms of Use of the Platform which are available on the Platform.

 2 Personal Data

 2.1 Data of personal nature – data that include, but are not limited to, the User’s username, the User’s name, registry code or personal identification code, date of birth.

 2.2 Contact information – data that include, but are not limited to, the User’s telephone number, e-mail address, postal address, and other contact information that the User had made public.

 2.3 Resume data – data that include, but are not limited to, expected remuneration, education, professional experience, referees and references, training undergone, fields of interest, skills, photos, and other data entered by the User.

 2.4 Tender data – data that include, but are not limited to, expected remuneration, Services provided in the past, referees and references, professional experience, licenses and permits, and other data entered by the User.

 2.5 Service data – data that include, but are not limited to, the description of the Service, the place where the Service shall be provided, the time when the Service shall be provided, the level of remuneration, and other data related to the Service.

 2.6 Advertisement data – data that include, but are not limited to, the User’s data of personal nature, contact information, resume data, tender data, Service data, and other data the User has entered into the Advertisement.

 2.7 Technical data – data that include, but are not limited to, data that has been received and collected from the device related to the use of the Platform.

 2.8 Cookie data – data collected by means of cookies.

 3 The Purposes of Processing Personal data, Personal Data Processed, and the Legal Basis

 3.1 The Manager processes personal data for the following purposes.

 3.1.1 Entering into an Agreement and enabling the use of the Platform – the Manager processes all personal data.

 3.1.2 Developing the Platform – the Manager processes, inter alia, technical data and cookie data.

 3.1.3 Sending and displaying advertising and marketing messages – the Manager processes, inter alia, Advertisement data, technical data, and cookie data.

 3.1.4 Sending and displaying personalized messages related to Services and Advertisements – the Manager processes, inter alia, Advertisement data, technical data, and cookie data. The process may also include making automated (i.e. without direct human intervention) decisions which includes profiling as one of its basis.

The legal basis for processing personal data is the User’s consent and the legitimate interest to enable more efficient use of the Platform.

 3.1.5 Complying with legal obligations – the Manager processes personal data specified in applicable legislation the Manager is obliged to comply with.

 3.1.6 Exercising the Manager’s rights that arise from legislation and the Agreement – personal data processed by the Manager depend on the rights the Manager exercises.

 4 Disclosure and Transfer of Personal Data

 4.1 When an Advertisement is entered and published, that Advertisement becomes visible to other Users and third persons.

 4.2 The User has a right to not enter certain Advertisement, resume, tender, or Service data or to hide such data, following which these data shall not be made visible to other Users and third persons.

 4.3 Entering and disclosing certain data is mandatory for entering into and fulfilling an Agreement, the User cannot refuse from the disclosure of such data. If the User shall not disclose mandatory data, entering into an Agreement or fulfilling it is not possible.

 4.4 In addition, the Service Purchaser has the right to mark the entire Advertisement as inactive, in which case the Advertisement shall not be disclosed to other Users and third persons. The Service Provider cannot mark the entire Advertisement as inactive, but they can close the Service Provider’s User Account.

 4.5 In case the Service Provider submits a tender to the Service Purchaser for providing a Service or applies to provide a service, the Service Provider’s tender data or resume data shall be transferred to the Service Purchaser.

 4.6 In case the Service Purchaser submits a tender to the Service Provider for having a Service provided to them, the Service Purchaser’s data and the Service data shall be transferred to the Service Provider.

 5 Retention of Personal Data

 5.1 Personal data shall be retained for as long as it is necessary in accordance with their purposes or for as long as is required by law. Generally, personal data shall be retained for up to three (3) years after the User Account has been closed.

 6 The User’s Rights

 6.1 The User has the right to request rectification and deletion of their personal data and restriction of its processing if this does not preclude the purpose of processing personal data or the Agreement.

 6.2 The User has a right to request that a decision concerning them is not adopted if the decision is based solely on automated decision-making and leads to legal consequences for the User or affects them considerably.

 6.3 The User has a right to withdraw their consent for processing their personal data if this does not preclude the purpose of processing personal data.

 6.4 The User has a right to lodge a complaint with a relevant supervisory authority if the User is of the opinion that processing their data infringes their rights and interests based on legislation governing data protection.
